Welcome to Wakefully ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our mobile application, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Users

Wakefully provides AI-powered dream analysis, journaling, and subconscious intelligence tools. Our Service is designed for individuals seeking personal insight through dream tracking and interpretation, as well as enterprise organizations using aggregated, anonymized emotional intelligence dashboards.

You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent.

2. Subscriptions & Payments

Wakefully offers both free and premium subscription tiers. Premium subscriptions provide access to advanced AI analysis, unlimited dream entries, pattern tracking, and personalized insights.

• Subscriptions are billed through Apple App Store or Google Play Store
• Auto-renewal occurs unless cancelled at least 24 hours before the end of the current period
• Refunds are handled through the respective app store's refund policy

3. User Content

You retain ownership of all content you submit to the Service, including dream entries, journal notes, and personal reflections. By using the Service, you grant us a limited license to process your content solely for the purpose of providing and improving the Service.

Your dream data is private by default. Individual dream content is never shared with employers, organizations, or third parties. Only aggregated, anonymized trend data may be used for enterprise dashboards, and only with explicit user opt-in.

4. AI-Generated Content

Wakefully uses artificial intelligence to analyze dreams and provide interpretations. AI-generated content is for informational and self-reflection purposes only. It does not constitute medical advice, psychological diagnosis, or therapeutic treatment.

Wakefully is not a replacement for professional therapy, counseling, or emergency mental health services. If you are experiencing a mental health crisis, please contact your local emergency services or a crisis hotline.

5. Privacy & Data Protection

Your privacy is fundamental to our service. Please review our Privacy Policy for details on how we collect, use, and protect your data. Key principles:

• Dream content is encrypted and stored securely
• Individual data is never sold to third parties
• Enterprise analytics use only aggregated, anonymized data
• You can export or delete your data at any time

6. Acceptable Use

You agree not to misuse the Service, including but not limited to: attempting to reverse-engineer the AI systems, using the Service to harass others, submitting content that violates applicable laws, or attempting to access other users' data.

7. Intellectual Property

The Service, including its AI models, algorithms, design, and branding, is owned by Wakefully and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Wakefully shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
